1. Acceptance
By accessing PackIndex at opnplatform.com, operated by Polimex Trade Inc. (Reg. 737573816, 10225 Yonge St, Richmond Hill, ON L4C 3B2, Canada), you agree to these terms. These terms apply to all users of the platform, including free visitors, contributors, and subscribers. If you do not agree, please discontinue use immediately.
2. Data & index disclaimer
All index values, commodity prices, market signals, and benchmarks published on PackIndex are for indicative reference purposes only. They are verified by our contributor network and intended as indicative reference benchmarks. They do not constitute financial, procurement, legal, or professional advice. Polimex Trade Inc. accepts no liability for decisions made based on PackIndex data.
3. Subscription & payment
Paid subscriptions are billed monthly or annually via Stripe. Subscriptions renew automatically unless cancelled before the renewal date. All fees are non-refundable except where required by applicable law. You may cancel at any time from your portal account — cancellation takes effect at the end of the current billing period.
4. Credits
Credits are purchased in advance and have no cash value. They are non-refundable and do not expire. Credits may be awarded through the Pulse contributor programme at OPN's discretion. OPN reserves the right to adjust credit pricing with 30 days' notice.
5. Intellectual property
The PackIndex methodology, index calculations, brand name, platform design, and all content are the exclusive property of Polimex Trade Inc. You may not reproduce, redistribute, scrape, or resell index data without a written commercial data licence. Limited personal use for internal procurement benchmarking is permitted under a paid subscription.
6. Contributor data
By submitting a Pulse signal you grant OPN a perpetual, non-exclusive, irrevocable, royalty-free licence to aggregate and publish the anonymised directional signal as part of the PackIndex model. Your company name, specific volumes, supplier names, and commercial values are never published.
7. Acceptable use
You may not use PackIndex or PACKIQ to: (a) reverse-engineer the index methodology for a competing product; (b) resell, sublicence, or redistribute agent outputs or index data; (c) train or fine-tune AI models using PackIndex data or PACKIQ outputs without a written licence; (d) use automated bots or scrapers to extract data at scale.
8. Limitation of liability
To the maximum extent permitted by law, Polimex Trade Inc. is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of PackIndex or PACKIQ. Our total liability to you in any 12-month period shall not exceed the subscription fees you paid in that period.
9. Changes to terms
We may update these terms at any time. Continued use of the platform after notice of changes constitutes acceptance. Material changes will be notified by email to registered users at least 14 days in advance.
10. Governing law
These terms are governed by the laws of the Province of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.
